This agreement stipulates the conditions of use and personal information processing for 'Virtual Tutor' (hereinafter "this Service"), an AI-based Korean learning service within the 'OppaLang' platform operated by BRN Company (hereinafter "the Company").
1. Definition of Service and Consent to Use
This Service is a real-time voice conversation service utilizing AI technology from ElevenLabs Inc.
By using this Service, the user is deemed to have fully agreed to these terms, the collection and use of personal information, and overseas transfer.
2. Refund Policy (Technical Issues and Cancellation)
Due to the nature of this Service involving immediate allocation of AI resources, the following refund policy applies.
User Change of Mind and Reservation Cancellation
- 12 hours before class starts: 100% refund upon cancellation
- Within 12 hours of class start: 50% refund upon cancellation
- After class starts (conversation begins): In principle, refunds are not possible.
Refunds due to Technical Failures (Exceptions)
- Company's fault: If it is confirmed that normal class progression was impossible due to technical defects on the 'Company' side, such as system server downtime or AI model unresponsiveness, 100% of the used cost will be refunded.
- User's fault: Failures caused by user network instability, microphone/speaker device errors, use of unrecommended browsers, etc., are excluded from refunds.
- Basis for judgment: Refund eligibility is finally determined based on the Company's system log records.
No-show
If the user does not connect at the reserved time, the service is considered fulfilled and is not refunded.
3. Precautions When Using AI Services (Disclaimer)
- As this Service is based on generative AI, the AI's responses may not always be 100% accurate or objective.
- If the AI uses inappropriate or biased expressions, the user can report it, and the Company will use it as data for service improvement. However, the Company does not bear legal responsibility for the contents of individual AI responses.
4. Purpose of Collection and Use of Personal Information
The Company collects minimal information for the following purposes.
- Learning service: Implementation of Korean conversation through real-time speech recognition (ASR) and synthesis (TTS) technology
- Achievement analysis: Measurement of Korean proficiency (Level), conversation summarization, and customized feedback generation
- Operation and improvement: Service usage statistical analysis, CS response, and AI model advancement
5. Items of Personal Information Collected
- Voice and conversation records: User's voice recording data, text conversion records (Transcription)
- AI analysis data: Conversation summary, Korean level, key learning points
- Service metadata: Call date and time, duration, used credits, and payment information
- Device information: Access IP, browser type, OS information (for technical support and fraud prevention)
6. Provision of Personal Information to Third Parties and Overseas Transfer
To implement AI agent technology, processing is entrusted to overseas partners as follows.
- Recipient: ElevenLabs Inc. (USA), Google LLC (USA)
- Purpose of provision: Real-time voice/text processing and learning data analysis via the Gemini model
- Items provided: Voice data, conversation text, and metadata for analysis
- Retention period: Until the purpose of the entrusted task is achieved and membership withdrawal
7. Retention and Destruction of Personal Information
- The Company retains information until membership withdrawal, and destroys it without delay after the purpose is achieved.
- However, if retention is necessary according to related laws such as the Act on Consumer Protection in Electronic Commerce (payment records 5 years, etc.), it will be kept for that period.
8. Right to Refuse Consent
- Users have the right to refuse this consent. However, since this Service requires conversation data analysis as essential, using the Virtual Tutor is not possible if refused.
